[Extraordinary remedies in the civil procedure system] Abstract This thesis deals with the Czech system of extraordinary remedies in civil proceedings, not only with their historical genesis and current functioning, but also with a focus on current issues related to them, especially in connection with the forthcoming recodification of civil procedure. The thesis is structured into chapters and is divided into a general part and a special part. In the general part, which includes chapter one, the author attempts to define the basic issues of extraordinary remedies and their distinction from ordinary remedies. Attention is thus paid to the subject of legal force, systems of appeal and the definition of types of defects in decisions, which can be used to distinguish one extraordinary remedy from another. The general part also includes a historical excursion into the legal regulation from the Civil Procedure Code of 1895 to Act No. 404/2012 Coll., which fundamentally changed the admissibility of appeals. Extraordinary Appeal in Criminal Proceedings Abstract This diploma thesis focuses on a comprehensive analysis of the legal regulation of extraordinary appeal, as one of the extraordinary remedies in criminal proceedings, which was introduced into Czech law with effect from 1 January 2002 by Act No. 265/2001 Sb. At first it focuses on general explanations of the appeal procedure, remedies and specific principles governing the appeal procedure, followed by historical overview of the development of extraordinary remedies. Then the diploma thesis deals with the institute of extraordinary appeal itself, namely, for a better understanding, at first in terms of general interpretations of the extraordinary appeal, and then analyses the individual issues. The main part of the diploma theses is devoted to applicable grounds for the extraordinary appeal, the interpretation of which considers the rich case law of the Supreme Court and the Constitutional Court, especially with regard to the ground of appeal under Section 265b (1) (h) al). The interpretive development of this provision, accompanied by contradictions between the Supreme Court and the Constitutional Court, which are sometimes referred to journalistically as a "war of the courts", was of fundamental importance for the introduction of a new ground of appeal...
Renewal of proceedings

Remedial measures in criminal law are set mainly to eliminate and correct mistakes, which have occurred in the course of the trial. It acts as a review and a remedy of law and legal defects. It can be divided into regular and special ones. Amid the regular remedial measures belong appeal, complaint and protest, to a group of special remedial measures belong apart from a renewal of proceedings, a review of an appeal and a complaint for the breach of law. Renewal of proceedings is a special remedial measure, which brings with itself interference into legal power. Renewal of proceedings with which one can contest only some legitimate decisions, in which criminal prosecution has already finished, is used for a removal of shortcomings in factual findings, because at that time all the decisive facts had not been known and the evidence, which came up only after the former decision has come into legal force. New evidence or facts underlying this extraordinary breach into inalterability and binding of judgments made in criminal proceedings are only the facts that were not part of evidence or survey or were not applied by any of the parties engaged in the proceedings and the only evidence that was not designed nor made by either party during the proceedings. Complaint against a violation of law in criminal matters

The aim of the present dissertation is to provide the fullest possible legal analysis of the complaint against a violation of law, including its historical and international context, and to endeavour to reflect critically on its current application in practice. In the author's approach, the review of criminal cases on the basis of the files prior to a possible application of this legal remedy is an indispensable object of study. Among other things, the work thoroughly analyzes the applicable grounds for the complaint against a violation of law, its purpose and role in the whole system of extraordinary remedies, and it describes the course as well as the specifics of the Supreme Court proceedings. Standard and optional methods of interpretation are complemented by an empirical examination of the sample of 80 complaints submitted to the Supreme Court, which is aimed at identifying and classifying the alleged flaws and the extent to which there might be an overlap with extraordinary appeal (dovolání). The chosen topic appears to be very timely with regard to the ongoing preparatory legislative work on the new Criminal Procedure Code. Action for retrial Abstract This diploma thesis deals with issues of action for retrial. Its aim is to describe contemporary form of this extraordinary remedy how as it is regulated in the act No. 99/1963 Coll., Civil Procedure Code., carry out its comparison with Slovakian regulation and with the substantive intent of the Civil Procedure Code and also submit solution to some aspects of possible future regulation. The thesis is divided into five chapters. The intention of the first chapter was to introduce basic terms and system, which includes action for retrial is its part. Part of this chapter is also dedicated to brief historical excursion, which tackles development of remedies since 1781 until publication of substantive intent of the Civil Procedure Code in the 2020 version. The second chapter covers the action for retrial itself. Its subchapters gradually analyse individual elements of this extraordinary remedy in the form of admissibility, the grounds for bringing the action, persons entitled to bring action, time limits, particulars of the action, proceedings and decisions on it, costs of the proceedings and court fees, as well as the issues of the status of action for retrial among other extraordinary remedies. Action for retrial and for nullity Abstract This diploma thesis deals with action for retrial and for nullity. The aim is to provide a systematic interpretation about both of these institutes and characterize them in a system of extraordinary remedies. Although both of them are regulated in part four chapter two of the Act No. 99/1963 Coll., Civil Procedure Code, as amended, their respective purposes are completely different. Action for retrial serves for a remedy of factual defects as a final decision could not stand due to a fundamental change of facts whereas action for nullity serves for a remedy of important procedural defects which affected court decision itself or proceeding preceding it. Both institutes can challenge a final decision and break the legal certainty brought by it. This diploma thesis contains four chapters. The first of them deals with remedial systems and remedies containing a brief characteristic of individual types of remedial systems and remedies. The second chapter addressing action for retrial and the third chapter dealing with action for nullity represent main parts of the thesis. Action for a new trial and action for a mistrial

The subject of my thesis is the Action for a new trial and action for a mistrial. The purpose of this thesis is to characterize these actions from point of view of their exceptionality as the extraordinary remedies, to compare their common and different features and to suggest the possible future legislation. The thesis is composed of seven chapters. The aim of the firts and the second chapter is to briefly characterize the redress procedures, the individual repair systems and the remedies from the general point of view, from which these two actions are patterned. The following chapter briefly describes the extraordinary remedies from the point of view of their characteristic signs and their representation in the present legislation. I am also mentioning the two important amendment of civil procedure, which are responsible of creation the system of remedies as we know it in present form in this chapter.
